Social contract theory offers a powerful method and metaphor for the study of organizational ethics. This paper considers the variant of the social contract that has arguably gained the most attention among business ethicists: integrative social contracts theory or ISCT [Donaldson and Dunfee: 1999, Ties That Bind (Harvard Business School Press, Boston)]. A core precept of ISCT - that consent to membership in an organization entails obligations to follow the norms of that organization, subject to the moral minimums of basic (...) human rights - is a reasonable and appealing notion. One potential challenge for those attempting to apply this idea, however, lies in the dynamic nature of social norms. Organizational norms evolve, often through the conscious efforts of community members and leaders. As currently formulated, ISCT offers a framework that under-appreciates the evolving nature of moral norms. In this paper, we extend ISCT by considering the circumstances under which the terms of and parties to social contracts change. Will stakeholder theory continue to transform how we think about business and society? On the occasion of this journal’s 60th anniversary, this review article examines the journal’s role in shaping stakeholder theory to date and suggests that it still has transformative potential. We conducted a bibliometric analysis of co-citations in the literature from 1984 to 2020. Reporting these results, we examine the field’s evolving structure. Contextualized theoretically as an accomplishment of institutional work—the creation of a meaningful and innovative field ideology—this (...) structure is remarkable for how it integrates ethical and behavioral arguments, invites engagement from adjacent domains, and arrives at important insights for business and society. Community-based participatory research (CBPR) focuses on specific community needs, and produces results that directly address those needs. Although conducting ethical CBPR is critical to its success, few academic programs include this training in their curricula. This article describes the development and evaluation of an online training course designed to increase the use of CBPR in mental health disciplines. Developed using a participatory approach involving a community of experts, this course challenges traditional research by introducing a collaborative process meant to encourage (...) increased participation by special populations and narrow the parity gap in effective mental health treatment and services delivery. All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. How can a business institution function as an ethical institution within a wider system if the context of the wider system is inherently unethical? If the primary goal of an institution, no matter how ethical it sets out to be, is to function successfully within a market system, how can it reconcile making a profit and keeping its ethical goals intact? While it has been argued that some ethical businesses do exist, e.g., Johnson and Johnson, the argument I (...) would like to put forth is that no matter how ethical a business institution is, or how ethical its goals are, its capacity to act in an ethical manner is restricted by the wider system in which it must operate, the market system. Unless there is a fundamental change in the notion of the market system itself, the capacity for individual businesses to act in an ethical manner will always be restricted. My argument is divided into two parts. The first part is to show the inherent bias towards unethical outcomes that is inherent in the market system. The second part is to suggest how to reorient the general economic framework in order to make ethical institutions more possible. The last half of Leviathan is designed to refute these claims in detail, and this refutation is not merely tacked onto the first parts but is a logical extension of them. The argument for escaping the state of nature is that only through obedience to a (...) common power can man escape the likelihood of an early death. Once that common power is established, and so long as it can carry out its protective function, obedience to it is obligatory. When a man enters civil society, the only right he retains is to defend himself against physical death, and consequently, the only time he is entitled to disobey the sovereign is when the sovereign directly threatens him. Thus excuses for rebellion are reduced to an absolute minimum. In McNeiily's formalization however, the concept of a man's death must be replaced by the formal concept of the frustration of all one's desires. And so "whatevvr [a man] regards as the complete frustration of all his desires... he will be entitled to resist, even if such resistance puts him at war with others, including lawful authority" (p. 193). Now the incredible range of things men have believed essential to avoiding the frustration of all their desires is amply testified to in the history of religious warfare. And clearly, under this formalized interpretation, men would be entitled to rebel over the form of baptism, church government, ministerial costume, prayer, or anything else if they are convinced it is essential to their salvation. It takes little knowledge of history to see that Hobbes's espousing of a theory with such consequences has a low degree of probability indeed. Hobbes complains in Leviathan of Scriptural exegetes who "by casting atoms of Scripture, as dust before men's eyes, make everything more obscure than it is." Rather, he claims, it is "not bare words, but the scope of the writer, that giveth the true light by which any writing is to be interpreted; and they that insist upon single texts, without considering the main design, can derive nothing from them clearly'" (E. W., III, 602). This last would be too harsh to apply to McNeiity's work generally, for his "atoms" are for the most part of considerable worth in themselves. This book examines the Condorcet Jury Theorem and how its assumptions can be applicable to the real world. It will use the theorem to assess various familiar political practices and alternative institutional arrangements, revealing how best to take advantage of the truth-tracking potential of majoritarian democracy.

The open borders view is frequently dismissed for making infeasible demands. This is a potent strategy. Unlike normative arguments regarding open borders, which tend to be relatively intractable, the charge of infeasibility is supposed to operate as what we call a "normative argument-stopper." Nonetheless, we argue that the strategy fails. Bringing about open borders is perfectly feasible on the most plausible account of feasibility. We consider and reject what we take to be the only three credible ways to save the (...) charge of infeasibility: by proposing an alternative account of feasibility; by proposing an alternative, more circumscribed interpretation of the subject-matter of feasibility claims; and by proposing a more expansive account of the addressees of the demand for open borders. The first fails to vindicate the claim that infeasibility is a normative argument-stopper. The second does not provide an argument against open borders at all. The third underestimates the power of at least some non-state actors. We conclude by drawing some lessons for the open borders view and the use of feasibility in politics more generally. (shrink)

Bracket out the wrong of committing a wrong, or conspiring or colluding or conniving with others in their committing one. Suppose you have done none of those things, and you find yourself merely benefiting from a wrong committed wholly by someone else. What, if anything, is wrong with that? What, if any, duties follow from it? If straightforward restitution were possible — if you could just ‘give back’ what you received as a result of the wrongdoing to its rightful owner (...) — then matters are morally more straightforward. But in real-world cases that is often impossible, and questions of ‘how much, from whom and to whom?’ become far more vexing. The beneficiary disgorging all benefits of the wrong is part of the story, but where that is not possible or will not suffice to compensate the victim of wrongdoing we discuss various ways of allocating the cost of making the victim whole, including supplementation from public coffers. The last half of Leviathan is designed to refute these claims in detail, and this refutation is not merely tacked onto the first parts but is a logical extension of them. The argument for escaping the state of nature is that only through obedience to a (...) common power can man escape the likelihood of an early death. Once that common power is established, and so long as it can carry out its protective function, obedience to it is obligatory. When a man enters civil society, the only right he retains is to defend himself against physical death, and consequently, the only time he is entitled to disobey the sovereign is when the sovereign directly threatens him. Thus excuses for rebellion are reduced to an absolute minimum. In McNeiily's formalization however, the concept of a man's death must be replaced by the formal concept of the frustration of all one's desires. And so "whatevvr [a man] regards as the complete frustration of all his desires... he will be entitled to resist, even if such resistance puts him at war with others, including lawful authority" (p. 193). Now the incredible range of things men have believed essential to avoiding the frustration of all their desires is amply testified to in the history of religious warfare. And clearly, under this formalized interpretation, men would be entitled to rebel over the form of baptism, church government, ministerial costume, prayer, or anything else if they are convinced it is essential to their salvation. It takes little knowledge of history to see that Hobbes's espousing of a theory with such consequences has a low degree of probability indeed. Hobbes complains in Leviathan of Scriptural exegetes who "by casting atoms of Scripture, as dust before men's eyes, make everything more obscure than it is." Rather, he claims, it is "not bare words, but the scope of the writer, that giveth the true light by which any writing is to be interpreted; and they that insist upon single texts, without considering the main design, can derive nothing from them clearly'" (E. W., III, 602). This last would be too harsh to apply to McNeiity's work generally, for his "atoms" are for the most part of considerable worth in themselves.
